Terms of Service

1. Acceptance of Terms

By accessing or using the Accountability platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Accountability is a fitness challenge platform that allows users to create and join group accountability challenges. Participants commit a monetary stake at the time of joining. No portion of the stake is collected upfront; instead, the participant's payment card is saved on file, and at the end of the challenge the participant is charged only the portion of their stake that was not earned through workout completion. Only a platform fee plus applicable taxes is charged upfront. The Service operates as a self-funded commitment device: each participant risks only their own committed stake and is charged only based on their own performance and their team's performance. The Service includes workout tracking, team chat, leaderboards, photo verification, and administrative tools for challenge management.

3. Eligibility and Age Verification

You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. You may be required to provide your date of birth during onboarding, and the platform may enforce age verification before permitting participation in paid challenges. Providing a false date of birth is a violation of these Terms and grounds for account termination. The Service is currently operated from Canada and available to users worldwide, subject to applicable local laws.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Challenge Participation

When you join a challenge with a monetary stake, you agree to the challenge rules, duration, workout requirements, and stake structure as displayed at the time of joining. Challenge rules are set by the challenge administrator and enforced through the platform. You acknowledge that no part of your stake is collected upfront, that your payment card is saved securely on file via Stripe, and that you authorize a charge at the end of the challenge equal to the unearned portion of your stake, calculated from your individual and team completion rates. You may customize your personal/team stake split within the range permitted by the challenge, with a minimum of 50% allocated to personal completion.

5a. Commitment and Lock-In

Paying your stake (or having your card placed on file as your stake commitment) creates a binding commitment for the full duration of the challenge. Once your stake is recorded, you may not: (a) leave the challenge, (b) downgrade your role to spectator, (c) end the challenge early, or (d) delete the challenge. The challenge administrator is also prevented from ending or deleting the challenge once any participant has paid in. This lock-in is intentional and non-waivable: it prevents participants from withdrawing to avoid the settlement charge that would otherwise apply to poor performance. If you are unable to continue performing due to illness, travel, injury, or other legitimate circumstances, you must use the Relief Week system instead of leaving. Requests for exceptions must be raised through the in-app dispute process described in our Dispute Policy; "changing your mind" or unhappiness with your own performance is not grounds for release from the challenge.

6. Payments and Fees

All payments are processed securely through Stripe. A non-refundable platform fee, plus any applicable taxes, is charged at the time of joining a paid challenge; this is the only charge made at join. Your card is saved on file via a Stripe SetupIntent and may be charged at the end of the challenge up to the stake amount based on completion. You agree that payment processing is subject to Stripe's terms of service. We do not store your payment card information directly.

7. Stake Policy

End-of-challenge charges are calculated based on your personal completion percentage and your team's average completion percentage, weighted according to the challenge's configured stake split (default 60% personal / 40% team). Settlement charges are processed automatically after challenge completion via Stripe against the card you saved on file. For full details, please review our Stake Policy. Platform fees and taxes are non-refundable. If you voluntarily leave a challenge before it completes, the incomplete portion of your stake may still be charged at settlement.

8. Workout Verification and Disputes

Challenge administrators may review submitted workouts for compliance with challenge rules. Other participants may flag workouts they believe are non-compliant. Flagged workouts are reviewed by the challenge administrator, who has final authority to approve or remove flagged submissions. Removed workouts affect your completion score and may increase the settlement charge made at the end of the challenge. For full details on the dispute process, please review our Dispute Policy.

9. User Conduct

You agree not to: (a) submit fraudulent workout check-ins or proof photos; (b) harass, bully, or intimidate other participants; (c) manipulate or exploit the scoring system; (d) use automated tools or bots to interact with the Service; (e) upload content that is illegal, offensive, or violates the rights of others; (f) attempt to gain unauthorized access to other accounts or platform systems; (g) abuse the flagging or dispute system in bad faith.

10. Content and Intellectual Property

You retain ownership of content you submit (photos, messages, notes). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service for the purpose of operating and improving the platform. We reserve the right to remove content that violates these Terms. The Accountability name, logo, and all related trademarks are our property.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law, Accountability and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or stake amounts charged. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. The Service is provided "as is" without warranties of any kind.

13. Indemnification

You agree to indemnify and hold harmless Accountability, its operators, affiliates, and their respective officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another user or third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any pending settlement charges for completed challenges will still be processed according to the applicable stake rules. Provisions of these Terms that by their nature should survive termination shall survive.

15. Not Gambling

The Service is a self-funded accountability commitment device and is not a form of gambling, wagering, or game of chance. Participants risk only their own committed stake and are charged only based on their own performance -- no participant's money is redistributed to another participant. Any shortfall charged at the end of a challenge is either retained by the platform to cover operational costs or donated to a registered charity, as configured by the challenge administrator. The outcome of a challenge is determined entirely by the participant's own effort and consistency, not by chance, luck, or the performance of others beyond the team completion component which participants voluntarily opt into.

16. Shortfall Charges

Any portion of a participant's stake that is not earned through workout completion is charged at the end of the challenge. Shortfall charges are handled according to the challenge's configuration, which is disclosed at the time of joining: they are either retained by the platform to support operations, or donated to a registered charity designated by the challenge administrator. Under no circumstances are shortfall charges redistributed to other participants.

17. Stake Limits

The platform enforces a maximum stake amount per challenge to promote responsible use. The current maximum stake is displayed at the time of joining. The platform reserves the right to adjust stake limits at any time and may require additional identity verification for higher stake amounts.

18. Card on File

By joining a paid challenge, you authorize Accountability to save your payment card securely on file through Stripe and to charge that card at the end of the challenge up to the stake amount based on the completion formula described in the Stake Policy. You may update or replace the saved card at any time before the end of the challenge from your Payment Methods settings. Failed charges may be retried against the updated card.

19. Governing Law

These Terms are governed by and construed in accordance with the federal laws of Canada and the laws of the Province of Ontario, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the Arbitration Act, 1991 (Ontario). If you are accessing the Service from outside Canada, you are responsible for compliance with your local laws.
